LETTER: Unrig the Courts Coalition Sends Letter to Senate Judiciary Committee Ahead of ‘Shadow Docket’ Hearing; 

Demands Additional Hearing on Expansion

SAN FRANCISCO, CA (September 29, 2021) — Take Back the Court joined our Unrig the Courts Coalition to send a letter to Senate Judiciary Committee Chair Dick Durbin and Subcommittee Chair Sheldon Whitehouse ahead of the Wednesday’s hearing on the Supreme Court’s so-called “shadow docket,” calling on the committee to hold an additional hearing as soon as possible about Supreme Court expansion.

The letter thanks the senators and the Judiciary Committee for holding a hearing on the shadow docket, a secretive process that allows the Court to issue major rulings on critical issues without even having to sign their names to their decisions. But the letter emphasizes that reforming the shadow docket and increasing transparency within the courts is not enough.

Take Back the Court raises awareness about the urgent need to expand the number of seats on the Supreme Court to address the theft of the court by Senator Mitch McConnell during the Obama Administration. Without adding seats, Congress will not be able to restore the right to vote, ensure reproductive freedom, protect workers, halt our climate emergency, or pass new legislation. Court expansion, which can be accomplished without a constitutional amendment, is the only reform that enables the un-rigging of the system and the restoration of democracy.
