John Roberts So Scared of Supreme Court Reform He Let Us Have One More Election

(June 27, 2023) – Today, the Supreme Court released its decision in Moore v. Harper, a case that threatened the very foundation of our democratic system. Take Back the Court released the following statement on behalf of its president, Sarah Lipton-Lubet, in response:

“It’s nice that the Supreme Court is letting us keep a little democracy as a treat, but let’s be clear: by only partially rejecting a completely baseless theory that would have upended our entire system of governance, the Court intentionally left the door open for election meddling in 2024.

“The fact that this case wasn’t laughed out of the Court is a sign of how far we have fallen. Worse, the right-wing justices crowned themselves the ultimate arbiters of future state election disputes. Don’t be surprised if we see Bush v. Gore 2.0 in 2024 or beyond.

“Under our current conservative supermajority, pundits and the news media celebrate a ‘win’ any time the Court doesn’t annihilate our entire democratic system in one fell swoop. But don’t be fooled into believing this is proof that these justices are friends of democracy. What rulings like this one actually highlight is just how afraid Roberts is of the momentum behind Court reform — and how far he’ll go to try to quell our power.

“The bar for a ‘victory’ with this Court is on the floor. We deserve better. We deserve a judiciary that puts the American people first. And we can only get it if we expand the Court.”
