NEW POLLING SHOWS PLURALITY OF VOTERS, 75% OF DEMOCRATS SUPPORT COURT EXPANSION

Huge and early momentum for legislation adding 4 justices to the Supreme Court

WASHINGTON, DC (April 20, 2021) — New Data for Progress and Demand Justice polling released today shows that 47 percent of voters support expanding the Supreme Court from 9 to 13 justices (versus 41 percent oppose) and a remarkable 75 percent of Democrats support the change. This poll comes just days after The Judiciary Act of 2021 was introduced in Congress, showing big and early momentum for legislation that is early in the education and awareness phase.

Take Back the Court Director Aaron Belkin issued the following statement in response:

“I cannot emphasize enough how quickly and how far the fight for Supreme Court expansion is moving. This new polling reflects a rapidly growing awareness that democracies cannot function when the courts act as an extension of a narrow political faction. The stolen, hyper-partisan court is functioning, for all intents and purposes, as an extension of the Republican Party — and the only legitimate and proportional solution is to add seats.

As Senator Markey remarked during the bill introduction last Thursday, there are three phases to any legislation - education, activation, and implementation. To see a plurality of support from voters and such overwhelming demand from Democrats the week we are starting education about this legislation is remarkable and a huge testament to the growing understanding that the only way to protect democracy is to add seats — and the only window to act is now.”

Take Back the Court raises awareness about the urgent need to expand the number of seats on the Supreme Court to address the theft of the court by Senator Mitch McConnell during the Obama Administration. Without adding seats, Congress will not be able to restore the right to vote, ensure reproductive freedom, protect workers, halt our climate emergency, or pass new legislation. Court expansion, which can be accomplished without a constitutional amendment, is the only reform that enables the un-rigging of the system and the restoration of democracy.
