SUPREME COURT ESCALATES ATTACK ON SEPARATION OF CHURCH AND STATE

Ruling threatens ability of students to feel welcome and safe in public schools

SAN FRANCISCO, CA (June 27, 2022) — Today, in a blatant show of discrimination and an affront to the founding principle that separates church and state, the Supreme Court’s right-wing supermajority allowed public school employees to pressure students into participating in religious activities. Take Back the Court released the following statement on behalf of its executive director, Sarah Lipton-Lubet, in response:

“Today’s ruling in Kennedy v. Bremerton betrays the bedrock American principle of the separation of church and state. The stolen Supreme Court should be upholding constitutional rights, not propagating religious favoritism. Time after time this term, this Court has eagerly abandoned decades of precedent in order to enact a right-wing agenda — including robbing Americans of their fundamental right to abortion. It’s abundantly clear that none of our constitutional rights are safe from this illegitimate right-wing Supreme Court majority. It’s equally clear that, having stolen the Court, the Republican justices intend to use it to enact Republican policy preferences by judicial fiat. The only way to prevent these justices from causing further damage is by expanding the Court.”


Take Back the Court raises awareness about the urgent need to expand the number of seats on the Supreme Court to address the theft of the court by Senator Mitch McConnell during the Obama Administration. Without adding seats, Congress will not be able to restore the right to vote, ensure reproductive freedom, protect workers, halt our climate emergency, or pass new legislation. Court expansion, which can be accomplished without a constitutional amendment, is the only reform that enables the un-rigging of the system and the restoration of democracy.
