TAKE BACK THE COURT STATEMENT ON FIRST DRAFT OF PRESIDENTIAL SCOTUS COMMISSION MATERIALS

SAN FRANCISCO, CA (October 14, 2021) — Take Back the Court Executive Director Sarah Lipton-Lubet today released the following statement in reaction to the first public draft report issued by the Presidential Commission on the Supreme Court.

“Since the Commission was formed, the Court has gutted the Voting Rights Act, effectively overturned Roe v. Wade in Texas, blocked President Biden’s eviction moratorium, reinstated Donald Trump’s cruel ‘Remain in Mexico’ policy, curtailed workers’ rights to organize, and eroded government transparency by ruling in favor of a Koch-backed dark money group.

“This Commission was always going to be, at best, a waste of precious time. But now the Biden Administration has gifted Republicans a propaganda document that uncritically repeats a slew of right-wing canards while downplaying the Court’s obvious decline into partisan warfare.

“These materials make clear that the Commission is living in a fantasyland. Those of us living in the real world see a brazenly political Court is dismantling our rights at warp speed.

“The good news is that it doesn’t matter what this Commission says: Congress, not a toothless commission, is where Court reform must originate — and support for the Judiciary Act expanding the Court is growing every day.”


Take Back the Court raises awareness about the urgent need to expand the number of seats on the Supreme Court to address the theft of the court by Senator Mitch McConnell during the Obama Administration. Without adding seats, Congress will not be able to restore the right to vote, ensure reproductive freedom, protect workers, halt our climate emergency, or pass new legislation. Court expansion, which can be accomplished without a constitutional amendment, is the only reform that enables the un-rigging of the system and the restoration of democracy.
